SWAP Company is engaged in the retail sale of do-it-yourself mosaic kits.

By placing an order on the Site, the Customer declares that they are purchasing the Products for strictly personal purposes and unrelated to any professional activity. They are therefore acting for purposes that fall outside the scope of their commercial, industrial, craft, or professional activity.

All orders placed on the site are subject to these general terms and conditions of sale.

ARTICLE 1 - THE CLIENT

The Customer declares to be a natural person, at least 18 years of age, and to have the legal capacity or parental authorization to place an order on the website. When registering their personal data during the ordering process, the Customer must ensure the accuracy and completeness of the data they provide, which is necessary for the performance of the service. In the event of an error in the recipient's contact information, the Company SWAP cannot be held responsible for the inability to deliver the product.

The Company SWAP reserves the right to cancel any order when the customer's IP address is located in a country different from the billing and/or delivery address.

ARTICLE 2 - THE PRODUCTS

The products offered for sale are those described on the Site. The products offered by the Company SWAP products comply with the standards applicable in France.
The Company SWAP takes the utmost care in presenting and describing its products to best inform the Customer. However, it is possible that minor errors may appear on the Website, which the Customer acknowledges and accepts. ARTICLE 3 - THE ORDER

Placing an order on the Site is subject to compliance with the procedure established by the Company The SWAP process involves a series of steps that the customer must follow to validate their order. Payment for purchases is made by credit card on a secure server via the Shopify Payment application (Mastercard, Visa, CB, ApplePay) or via the Paypal platform.

Under no circumstances will the company SWAP does not have access to the customer's bank details.

In this regard, the Client expressly acknowledges that the communication of their bank card number to the Company SWAP constitutes authorization to debit your account up to the amount of the products ordered.

3. DATA

The data recorded and stored by the Company SWAP constitutes proof of the order and all transactions. The data recorded by the payment system constitutes proof of the financial transactions.

ARTICLE 5 - DELIVERY

SWAP delivers its products to France, Andorra, Monaco, England and the European Union.

Delivery is made to the delivery address indicated by the customer, it being specified that this must be the customer's residential address or that of any other natural person of their choice.

The indicated delivery times are indicative, corresponding to average processing and delivery times. The Company SWAP cannot be held responsible for consequences due to a delivery delay that is not its fault.

The customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, floor, access codes, names and/or intercom numbers, etc.).

In the event of damaged packages (already opened, missing products, etc.), the Customer agrees to notify the carrier and the Company SWAP , by any means, any reservations within 3 days of receiving the product.

The Company SWAP cannot be held responsible for consequences due to a delivery delay that is not its fault.

ARTICLE 6 - RETURNS

The customer has 14 days to return their package. Return shipping costs are the responsibility of the customer.

ARTICLE 7 - RIGHT OF WITHDRAWAL

The individual customer has a right of withdrawal, which they may exercise without giving any reason, within fourteen (14) clear days from the delivery of the order, which will be exercised by returning the new products (in their original packaging) at their own expense, accompanied by the order number, to the following address:

The Company SWAP will reimburse the Customer for any sums already paid, less any shipping costs, under the conditions referred to in Article 8.

ARTICLE 8 - REFUND

Refunds for products under the circumstances referred to in Articles 2 and 7 will be made by the Company SWAP will process the refund within a maximum of 30 days of receiving the returned products. The refund will be issued via the payment method chosen by the customer at the time of their order or by issuing a voucher.

When delivered via Mondial Relay, the parcel is available for up to 8 days at the collection point chosen by the customer. After this period, the parcel is returned to our workshop. Service and payment fees are also non-refundable.

When you subscribe to our newsletter, or when you place an order accepting the use of your personal data (SMS, email), SWAP may use this data for promotional purposes.

Under no circumstances, SWAP will not share this data with any third party for promotional purposes. This data may be shared with logistics partners solely for order tracking purposes.

ARTICLE 10 - APPLICABLE LAW

All orders imply the customer's full acceptance of the general terms and conditions of sale.

These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
